Welcome to Thinkcast. These Terms of Service (“Terms”) govern your access to and use of the Thinkcast web platform, services, and any generated content (collectively, the “Services”).
By registering for an account or using the Services, you agree to be bound by these Terms. If you do not agree, do not use Thinkcast.
1. Description of Service
Thinkcast is an AI-powered content automation platform that assists creators and teams in brainstorming ideas, generating video scripts, creating short-form videos, and scheduling content for publication across various third-party social media platforms.
2. Account Registration and Eligibility
- Eligibility: You must be at least 18 years old to use Thinkcast. By using the Services, you represent that you meet this requirement.
- Authority: If you are using Thinkcast on behalf of an organization or entity, you represent that you have the authority to bind them to these Terms.
- Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.
3. Acceptable Use Policy
When using Thinkcast, you agree not to:
- Use the platform for any illegal, harmful, or fraudulent activities.
- Generate or publish content that is defamatory, obscene, deceptive, or violates the intellectual property or privacy rights of others.
- Circumvent, disable, or interfere with security-related features of the platform.
- Attempt to reverse engineer, decompile, or extract the source code of the Thinkcast software.
- Abuse our automation tools, API limits, or use the system to distribute spam or malicious software.
We reserve the right to suspend or terminate accounts that violate this Acceptable Use Policy without prior notice.
4. AI-Generated Content Disclaimer
Thinkcast utilizes advanced artificial intelligence models to assist in content creation.
- Probabilistic Nature: AI outputs are probabilistic. We do not guarantee the accuracy, reliability, or appropriateness of the generated scripts, captions, or videos.
- User Responsibility: You are solely responsible for reviewing, editing, and approving all AI-generated content before it is scheduled or published to your social media accounts.
- No Liability: Thinkcast is not liable for any negative outcomes, platform penalties (e.g., strikes, shadowbans), or audience reactions resulting from the content you publish using our platform.
5. Third-Party Platforms and APIs
Thinkcast's core functionality involves interacting with third-party social media platforms via their APIs (including but not limited to YouTube, TikTok, Facebook, Instagram, LinkedIn, and X).
- Compliance with Third-Party Terms: By connecting these platforms, you agree to comply with their respective Terms of Service. It is your responsibility to ensure your published content adheres to their community guidelines.
- API Availability: Our ability to publish your content depends on the continuing availability of these third-party APIs. We are not responsible if a third-party platform changes its API rules, limits our access, or suspends your individual social media account.
6. Intellectual Property & User Content
- Your Content: You retain all ownership rights to the original ideas, prompts, and media you upload to Thinkcast, as well as the final videos generated for you.
- License to Thinkcast: You grant us a worldwide, non-exclusive, royalty-free license to host, process, and distribute your content strictly for the purpose of providing and operating the Thinkcast service (e.g., storing it in our databases and transmitting it to social media platforms on your behalf).
- Our Intellectual Property: Thinkcast retains all rights, title, and interest in our software, platform design, algorithms, and branding.
7. Fees, Subscriptions, and Cancellation
- Billing: Certain features of Thinkcast may be offered on a paid subscription basis. Paid plans are billed recursively according to your selected billing cycle.
- Changes in Pricing: We reserve the right to modify our pricing. We will provide reasonable advance notice of any upcoming changes.
- Refunds: All fees paid are non-refundable unless legally mandated otherwise.
- Cancellation: You may cancel your subscription at any time through your dashboard settings. Upon cancellation, you will retain access to paid features until the end of your current billing period.
8. Disclaimer of Warranties
The Thinkcast platform is provided on an "AS IS" and "AS AVAILABLE" basis.
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the services will be uninterrupted, error-free, secure, or that they will result in viral growth or financial outcomes for your social media channels.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Thinkcast, its creators, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or goodwill, arising out of your access to or use of (or inability to use) the platform.
In no event shall our total aggregate liability to you exceed the absolute amount you have paid us in the twelve (12) months preceding the event giving rise to the claim.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Thinkcast officially operates, without regard to its conflict of law provisions.
11. Changes to the Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use Thinkcast after those revisions become effective, you agree to be bound by the revised terms.
